By using Legend Memory, including the wearable device, companion apps, website, and related services, you agree to these Terms. If you do not agree, please do not use our services. You must be at least 18 years old to use Legend Memory, or you must have verifiable parental consent. If you accept these Terms on behalf of a company or organization, you represent that you have authority to bind that entity.
When you register, you will provide information such as your email address and any payment details for paid features. You agree your information is accurate and current. You are responsible for keeping your login credentials secure and for any activity on your account. If you believe your account has been compromised, notify us immediately at [email protected].
Legend Memory may offer paid subscriptions and one-time purchases. Any fee-based features will be clearly identified before purchase. Fees are in local currency where available. We may change prices, introduce new fees, or run promotions. We will give reasonable notice before price changes take effect. Continued use after changes means you accept the updated terms. If you subscribe to a membership, it will auto-renew at the then-current price unless you cancel before the renewal date. You can manage or cancel in your account or by contacting [email protected]. If your membership lapses, membership benefits, including warranty coverage described below, will pause until you reactivate.
We ship devices to the address you provide at checkout. Delivery times are estimates and may vary due to factors outside our control.
If you are not satisfied, you can return your device within 30 days of delivery. Devices must be in original condition with all accessories. Return shipping costs are your responsibility unless the product is defective. See our Refund Policy for full details, or to start a return, email [email protected]. This policy does not limit any rights you may have under applicable consumer laws.
Legend Memory devices are covered by a limited hardware warranty while your membership is active. The warranty term is 2 years from delivery in Australia, and 1 year from delivery everywhere else, including the United States. This warranty covers manufacturing defects and functional failures under normal use for devices purchased from Legend Memory or received as a gift. It does not cover accidental damage, water damage, exposure to liquids, environmental damage, misuse, abuse, neglect, improper storage, failure to follow care and safety instructions, cosmetic wear and tear, loss or theft, or damage from unauthorized repairs, modifications, or third-party parts and accessories. To make a claim, email [email protected] with your order details, a description of the issue, and photos or video if helpful. We may provide troubleshooting steps and may require the device to be returned for evaluation. If covered, we will repair or replace with a new or refurbished unit of equal or better functionality. We cover return shipping for covered warranty claims, and the cost of the replacement shipment back to you. Warranty coverage is tied to an active membership. If your membership ends, coverage pauses until reactivation, and resumes for the remainder of the original term. Replacements do not extend or renew the warranty beyond the original coverage period. Full warranty details, including how to make a claim, are on our warranty page. This warranty gives you specific rights, and you may have other rights that vary by jurisdiction. Nothing in this warranty excludes, restricts, or modifies any consumer rights under the Australian Consumer Law or other laws that cannot be excluded, restricted, or modified.
Do not expose the device to liquids or operate it in conditions outside the recommended operating guidelines. Use only approved chargers and accessories. Improper use can result in damage that is not covered by the warranty.
Audio of others. Legend captures audio metadata around you. You are responsible for following the recording laws where you use it, including getting consent from the people whose audio is included where the law requires it, and for not using it where recording is prohibited. You agree to indemnify Favs HQ, Inc. for claims arising from your use of Legend.
Voices of others. You may add another person's voice to Legend only with that person's consent.
AI features. Legend uses third-party AI providers (listed in our Privacy Policy) to process your content. AI output such as transcripts, summaries, tasks, and answers can be wrong or incomplete. Check important information yourself. It is not legal, medical, financial, or other professional advice.
Your content. You keep ownership of your content. You let us host, store, and process it, and share it with our providers, only to provide and improve Legend.
We grant you a limited, non-exclusive, revocable, non-transferable license to use the apps and services for your personal or internal business purposes. You may only install the app on devices you own or control. You may not reverse engineer, distribute, or sublicense the app. All Legend Memory content and materials are protected by intellectual property laws and remain our property.
You must comply with applicable laws and these Terms. Do not use the service to defraud, harass, send spam, infringe rights, or interfere with others. We may suspend or terminate access if you violate these Terms.
Our services may link to or integrate with third-party services. These links are provided for convenience and are not endorsements. Use third-party services at your own risk and subject to their terms and policies.
We may modify, suspend, or discontinue parts of the service at any time. If a change materially affects your use, we will try to inform you in advance.
We aim to keep Legend Memory safe and operational, but the service and devices are provided "as is" and "as available." We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes, restricts, or modifies any consumer guarantees under the Australian Consumer Law or other non-excludable rights. To the fullest extent allowed by law, our total liability arising out of or relating to the services or devices will not exceed the amount you paid for the product or service that gave rise to the claim. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
If permitted by applicable law, you agree to indemnify and hold harmless Legend Memory and its team from claims, losses, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the services or devices.
If you are an Australian resident, these Terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales will have jurisdiction. If you are not an Australian resident, these Terms are governed by the laws of California, United States, and the state and federal courts located in California will have jurisdiction.
We may revise these Terms. When we do, we will update the "Last updated" date. If material changes are made, we will notify you in advance by email or in-app notice. Continued use after updates means you accept the new Terms.
